1. Acceptance of terms

By accessing or using SpeakUPgrade at speakupgrade.com or app.speakupgrade.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

2. Description of service

SpeakUPgrade is an AI-powered public speaking coaching application. It records your speech sessions, analyzes your delivery using artificial intelligence, and provides scores and feedback to help you improve your public speaking skills.

The service is available as:

  • An Android mobile application
  • A web application at app.speakupgrade.com

3. Eligibility

You must be at least 13 years of age to use SpeakUPgrade. By using the service, you confirm that you meet this requirement. If you are under 18, you confirm that you have parental or guardian consent.

4. Account access

Access to SpeakUPgrade requires a verified email address. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. Notify us immediately at contact@speakupgrade.com if you suspect unauthorized access.

5. Free and Pro plans

Free plan: Includes 5 graded sessions per month. Daily challenge sessions are unlimited and free regardless of plan. Free users have access to all scores, transcripts, and basic feedback.

Pro plan: Includes unlimited sessions, full feedback, interactive speech timeline, session history, and all Pro features. Pro is billed monthly at 9.99 EUR/month or annually at 99.99 EUR/year.

Prices may change with 30 days notice to existing subscribers.

6. Payment and billing

Pro subscriptions are processed by Stripe. By subscribing, you authorize recurring charges to your payment method at the selected billing interval. Subscriptions renew automatically unless cancelled before the renewal date.

7. Refund policy

You may request a full refund within 14 days of your initial purchase. This is in accordance with EU consumer rights regulations (Right of Withdrawal).

After 14 days, refunds are not available. Partial refunds for unused subscription periods are not provided.

To request a refund, contact us at contact@speakupgrade.com with your registered email address and purchase details. We will process eligible refunds within 10 business days.

8. Acceptable use

You agree not to:

  • Use SpeakUPgrade for any unlawful purpose
  • Attempt to reverse engineer, decompile, or extract the source code of the application
  • Use automated tools to access the service or scrape data
  • Share your account with others
  • Upload content that is illegal, harmful, abusive, or violates the rights of others
  • Attempt to circumvent usage limits or subscription requirements

We reserve the right to suspend or terminate accounts that violate these terms.

9. Your content

When you use SpeakUPgrade, you submit audio recordings and receive AI-generated analysis. You retain ownership of any content you submit. By submitting content, you grant SpeakUPgrade a limited license to process it solely for the purpose of providing the service.

Audio recordings and video frames are deleted immediately after analysis. We do not use your content to train AI models.

10. AI-generated content

SpeakUPgrade uses artificial intelligence to analyze your speech and generate feedback. AI-generated scores and feedback are provided for coaching and self-improvement purposes only. They are not professional assessments and should not be relied upon as such.

AI analysis may occasionally produce inaccurate or unexpected results. We do not guarantee the accuracy of any AI-generated output.

11. Availability and changes

We strive to keep SpeakUPgrade available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features of the service at any time.

We reserve the right to modify these Terms of Service at any time. Continued use of the service after changes constitutes acceptance of the updated terms. We will notify users of significant changes via email.

12. Limitation of liability

To the maximum extent permitted by applicable law, SpeakUPgrade shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability to you for any claim arising from use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Disclaimer of warranties

SpeakUPgrade is provided “as is” without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, uninterrupted, or that results will be accurate.

14. Governing law

These terms are governed by the laws of the European Union and applicable member state law. Any disputes shall be resolved through good faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts competent for the registered place of business.
